Article 2 — Applicability
2.1. These general terms and conditions apply to every offer made by the entrepreneur and to every distance contract concluded between the entrepreneur and the consumer.
2.2. Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer.
2.3. Insofar as a provision of these general terms and conditions conflicts with mandatory Dutch consumer law, consumer law prevails.
Article 3 — The offer
3.1. If an offer has a limited period of validity or is made subject to conditions, this will be explicitly stated in the offer.
3.2. The offer contains a complete and accurate description of the products offered.
3.3. Products are sold in used or refurbished condition, unless explicitly stated otherwise. Slight signs of use are normal and not a reason for complaint or dissolution, provided they fall within the described condition category.
3.4. Obvious mistakes or errors in the offer do not bind the entrepreneur.
Article 4 — The agreement
4.1. The agreement is concluded at the moment the consumer accepts the offer and fulfills the conditions set forth therein.
4.2. If the consumer has accepted the offer electronically, the entrepreneur will immediately confirm receipt of the acceptance electronically.
4.3. The entrepreneur will take appropriate technical and organizational measures to secure the electronic transfer of data.
Article 5 — Prices
5.1. The prices stated in the offer are in euros and include VAT, unless otherwise stated. Shipping costs are stated separately prior to the conclusion of the agreement.
5.2. Prices are fixed for the duration stated in the offer, subject to price changes due to changes in VAT rates.
Article 6 — Payment
6.1. Payment is made in advance via the payment methods offered on the website (including iDEAL, credit card, and other methods).
6.2. The consumer has the obligation to immediately report any inaccuracies in payment data provided to the entrepreneur.
Article 7 — Delivery and execution
7.1. The place of delivery is the address that the consumer has made known to the entrepreneur.
7.2. The entrepreneur will execute accepted orders with due speed, but no later than within 30 days, unless a different delivery period has been agreed upon.
7.3. Shipping within the Netherlands takes place via PostNL or DHL. A track & trace code will be provided by email.
7.4. Pick-up in Amsterdam is possible by appointment. Location and time will be coordinated by email after the order.
7.5. The risk of damage and/or loss of products rests with the entrepreneur until the moment of delivery to the consumer.
Article 8 — Right of withdrawal
8.1. The consumer can dissolve an agreement during a cooling-off period of 14 days without giving reasons.
8.2. The cooling-off period starts on the day after the consumer has received the product.
8.3. During the cooling-off period, the consumer will handle the product and its packaging with care.
8.4. The consumer is liable for any depreciation of the product resulting from use that goes beyond what is necessary to assess the product.
8.5. The full procedure is described in the separate Return Policy.
Article 9 — Conformity and warranty
9.1. The entrepreneur guarantees that the products comply with the agreement and the specifications stated in the offer.
9.2. For refurbished and second-hand products, the statutory duty of conformity applies proportionally to the nature of the product.
9.3. Additional commercial warranty: The entrepreneur offers a 6-month hardware warranty. If a product shows a hardware defect within 6 months of receipt that does not result from normal use, the entrepreneur will replace the product or fully refund the purchase price. This is a commercial warranty offered by YAKOOT, not by the manufacturer.
9.4. The warranty does not apply in cases of: damage due to drops, liquids, or improper use; damage due to software installed by the consumer; normal wear and tear; defects mentioned in the offer.
9.5. This commercial warranty does not affect the consumer's statutory rights.
Article 10 — Complaints
10.1. Complaints must be submitted fully and clearly described to the entrepreneur via info@yakoot.nl within a reasonable time.
10.2. Complaints will be answered within 14 days.
10.3. The consumer can also submit a complaint via the European ODR platform: https://ec.europa.eu/consumers/odr/
Article 11 — Applicable law and disputes
11.1. Agreements are exclusively governed by Dutch law.
11.2. Disputes will be submitted to the competent Dutch court.
Article 12 — Amendment of the general terms and conditions
12.1. The entrepreneur is entitled to amend these terms and conditions. Amendments will take effect 30 days after publication on the website.
